DENSYS LTD. SECURES FINAL JUDGMENT EXCEEDING $18 MILLION AGAINST 3SHAPE FOR WILLFUL PATENT INFRINGEMENT AS APPEALS COURT DISMISSES CHALLENGE
JERUSALEM, ISRAEL – Densys Ltd. (Densys3D) today announced a decisive double victory in its long-standing patent dispute against 3Shape Trios A/S. The United States Court of Appeals for the Federal Circuit (CAFC) has granted Densys’ motion to dismiss 3Shape’s appeal (Appeal No. 26-1221), firmly cementing a final judgment exceeding $18 million entered by the U.S. District Court for the Western District of Texas. The legal victories follow a unanimous federal jury verdict and subsequent bench trials confirming that 3Shape is guilty of willful induced infringement of core patents invented by Densys CEO and Founder Dr. Maurice Moshe Ernst. The court also denied all of 3Shape's equitable defenses, validating Dr. Ernst as the originating inventor of foundational patents for full mouth real time intra oral 3D computerized mapping, the entry point into dental digital technology, the ecosystem of the world of digital dentistry with the gamut of new equipment, materials and treatments.
Appellate Dismissal Solidifies $18 Million Award
The CAFC dismissed 3Shape’s appeal for lack of jurisdiction, refusing to allow the early appeal. The final ordered judgment exceeds $18 million, inclusive of jury damages, enhanced penalties for verified willful infringement, pre-judgment interest, and court costs.
Ongoing Enforcement Campaigns Expand
The dismissal reinforces Densys' momentum in protecting its pioneering R&D. These core innovations serve as the front end of digital dentistry workflows. Densys is moving forward with its active federal patent infringement campaigns in the District of Delaware against other dominant industry participants, including Align Technology (Case 1:25-cv-00768) and Medit Corp (Case 1:25-cv-00769).
